Meta, Google Face Legal Assault on 30-Year-Old Shield

Meta Platforms and Google are facing a mounting wave of lawsuits that challenge the long-standing legal shield protecting online platforms from liability for user-generated content. This legal onslaught, amplified by the evolving landscape of artificial intelligence, signals a potential seismic shift for tech giants that have historically relied on Section 230 of the Communications Decency Act.

Recent verdicts have begun to chip away at these protections. A New Mexico jury found Meta liable in a child safety case, while in Los Angeles, Meta and Google’s YouTube were deemed negligent in a personal injury trial. These outcomes, though resulting in relatively modest financial penalties thus far, establish a troubling precedent for companies whose future hinges on AI-driven services. The core of these legal challenges lies in their strategic design to circumvent Section 230, a law enacted in 1996 that shields websites from lawsuits over content posted by users and allows for content moderation without incurring liability.

The plaintiffs’ attorneys are employing innovative legal strategies, arguing that these platforms are no longer passive conduits but active participants in shaping user experience and, in some cases, contributing to harm. In the recent class-action lawsuit against Google related to the Jeffrey Epstein case, plaintiffs contend that Google’s AI Mode, which provides AI-powered summaries and links, is “not a neutral search index.” This framing directly challenges the notion that Google merely sits between users and information.

“The plaintiffs’ bar is winning the war against Section 230 through systematic, relentless litigation that is causing there to be divots and chinks in its protection,” remarked Eric Goldman, a law professor at Santa Clara University School of Law.

The stakes are particularly high as the tech sector transitions from an era dominated by traditional online search and social networking to one defined by artificial intelligence. AI models developed by these tech giants are now generating conversational content, images, and videos that can be controversial or even illegal.

Senator Brian Schatz (D-Hawaii) has voiced concerns that tech companies have long used Section 230 as an excuse to avoid taking meaningful action to protect users, especially children, from harm, harassment, abuse, fraud, and scams. He argued that companies are aware of these issues but refrain from addressing them if it impacts their bottom line, a strategy facilitated by federal law’s protective shield.

While legislative reforms to Section 230 have been debated for years, they have largely stalled in Washington, D.C. However, plaintiff attorneys are demonstrating efficacy in pursuing alternative legal avenues.

The Los Angeles verdict against Meta and YouTube marked a significant development, as it was the first time a jury found social media platforms liable for intentionally engineering addictive features in their products, particularly targeting minors. The case focused on the design of the platforms themselves, rather than solely on the content they hosted. Plaintiffs argued that features like autoplay, recommendation algorithms, and notifications acted as “digital casinos,” contributing to severe mental health issues for young users who reported an inability to disengage from the apps.

Similarly, the class-action suit against Google, filed by a plaintiff using the pseudonym Jane Doe, alleged that the company’s AI Mode generated its own summaries and links, inadvertently exposing personal identifying information (PII) of Epstein victims, including names, phone numbers, and email addresses. Kevin Osborne, the plaintiff’s attorney, stated that the lawsuit was prompted by Google’s refusal to remove the victims’ contact information from AI Mode. Osborne emphasized the urgency of the situation due to the rapid dissemination of the compromised information, noting that “people are getting calls from total strangers and death threats. It’s a nightmare.”

Osborne also highlighted the innovative nature of the Google AI Mode suit, stating that “this is AI mode coming up with its own content and that’s something that’s not been explored very thoroughly by the courts.”

Matthew Bergman, representing plaintiffs in the Los Angeles case, testified before a Senate committee, asserting that the tech industry has exploited broad interpretations of Section 230 to “evade all possible legal accountability simply because third-party content is found somewhere in the causal chain of their misconduct.” Bergman cited a 2021 appeals court ruling involving allegations about a Snapchat feature contributing to a fatal car crash. The court reversed an earlier decision to dismiss the case under Section 230, acknowledging the plaintiff’s allegations that Snap’s negligent design incentivized reckless driving among young users.

The evidence presented in Los Angeles aimed to demonstrate that Meta and YouTube executives were aware of the harms caused by their product designs and failed to implement adequate remedies. Bergman indicated that the case’s strength lay in the internal documentation of the tech companies themselves.

The Google AI Mode suit also points to design flaws in how personal information is displayed, alleging that “Google is intentionally furnishing that PII in a way designed, or at least substantially certain, to fuel harassment and fear.” Osborne elaborated, noting that Google not only provided the victim’s email address but created a direct link that facilitated immediate email generation to survivors.

This situation is not isolated to Google. The creator of ChatGPT, OpenAI, is also facing scrutiny. Earlier in March, a lawsuit was filed against Google, alleging that its Gemini chatbot encouraged a user to plan a “catastrophic accident,” which the lawsuit claims led to the user’s suicide. This follows a January settlement by Google and Character.AI with families who alleged their technologies contributed to harm, including suicides, among minors. Last year, OpenAI was sued by a family blaming ChatGPT for their teenage son’s death by suicide.

Legal experts suggest that appeals in these cases could reach the Supreme Court, potentially shaping the future interpretation of Section 230 and the extent of legal protections afforded to tech companies. David Greene, senior counsel at the Electronic Frontier Foundation, cautioned that these are “very preliminary decisions” and that consensus remains elusive on whether product features fall under Section 230 or First Amendment protections. “Just labeling something as a design feature means nothing,” Greene stated. “If it’s speech, it’s speech and it gets both First Amendment protection and potentially Section 230 protection as well.”

Nadine Farid Johnson, policy director at the Knight First Amendment Institute at Columbia University, advocates for a more nuanced legislative approach. She suggests that tech companies could retain Section 230 protections by meeting specific conditions related to data privacy, platform transparency, and other prerequisites. Johnson expressed concern that as platforms increasingly adopt generative AI and sophisticated algorithms, these legal challenges will evolve into a “game of essentially whack-a-mole with every new iteration.”
