NAACP Sues Elon Musk’s xAI Over Memphis Air Pollution

The lawsuit, lodged with the U.S. District Court for the Northern District of Mississippi, outlines allegations that between August and December 2025, xAI and its subsidiary MZX Tech, LLC, deployed and operated 27 gas turbines in Southaven, Mississippi. The complaint asserts these operations were conducted “without an air permit or regard for the health and safety of people living nearby,” raising immediate environmental justice concerns.

These turbines are reported to be emitting smog-forming pollutants and fine particulate matter. Such emissions can significantly elevate health risks for nearby residents and contribute to unpleasant atmospheric conditions, impacting the quality of life in the affected communities.

The NAACP is seeking comprehensive legal recourse, including declaratory and injunctive relief. Their demands are for the companies to “cease operating the Colossus Gas Plant unless and until they obtain the required permits; to apply the necessary pollution controls; and to pay appropriate civil penalties for each day of violation.” This action underscores the organization’s commitment to environmental stewardship and public health.

“Our right to clean air is not up for negotiation, especially when companies prioritize expediency over people,” stated an NAACP representative in a press release. Now operating under the umbrella of SpaceX, following a significant merger this year, xAI has been utilizing natural gas-burning turbines to power its operations in Southaven, Mississippi, for several months. The company’s defense has been that no federal permit was required due to the perceived temporary nature of these installations. However, the ongoing nature and scale of these operations appear to contradict this claim.

xAI’s infrastructure includes the Colossus 1 and Colossus 2 data centers located in Memphis, just across the state line in Mississippi. The company’s expansion plans are substantial, with a new facility, codenamed Macrohardrr, slated for construction in Southaven. This project also involves building a more permanent power generation facility, which will feature 41 natural gas-burning turbines to meet the immense energy demands of its expanding data centers.

The lawsuit emphasizes the demographic impact of these operations, noting that tens of thousands of people live, work, and study in close proximity to xAI’s current power plant. The broader Memphis metropolitan area is home to hundreds of thousands more. A critical point raised in the filing is that “a much larger share of this population is Black than that of the country’s population as a whole,” pointing to potential environmental justice disparities.

In a parallel action, the NAACP is urging Mississippi state regulators to revoke a permit that was granted to xAI in March. This permit reportedly authorized the construction of the company’s extensive power plant in Southaven, complete with the 41 permanent turbines. The NAACP contends that this permit was issued without adequate environmental review, particularly concerning the cumulative impact of such a large facility.

Elon Musk, consistently ranked among the world’s wealthiest individuals, has strategically positioned the greater Memphis area as a crucial hub for xAI’s ambitious expansion. This move is vital as xAI strives to carve out a significant market share in the hyper-competitive artificial intelligence landscape, challenging established players like OpenAI, Anthropic, and Google.

The company has already attracted regulatory attention globally. The European Commission and U.K. online safety regulators, among others, have launched probes into xAI’s practices. These investigations were triggered by the controversial capabilities of its AI chatbot, Grok, and its image generator, which were found to facilitate the widespread creation and dissemination of deepfake explicit content. This content was reportedly based on images of real individuals, including children, who had not granted their consent, raising severe ethical and legal questions about the responsible development and deployment of AI technologies.

Amidst these significant controversies, SpaceX finalized its acquisition of xAI in February. The transaction, valued at $1.25 trillion for the combined entity, is seen as a strategic move to consolidate resources and expertise ahead of what is anticipated to be a record-breaking initial public offering in the coming months.

In this high-stakes legal battle, the NAACP is being represented by prominent environmental advocacy groups: Earthjustice and the Southern Environmental Law Center, signaling the seriousness and complexity of the environmental and civil rights issues at play.
