Micron Cites National Security, Seeks to Vacate Court Order Requiring Release of 73-Page Document to Yangtze Memory Technologies

In a legal dispute between Micron and YMTC, Micron is fighting to avoid handing over 73 pages of 3D NAND technology documents to the Chinese company. Micron, citing national security concerns due to YMTC’s placement on the US entity list, considers the court’s decision to grant YMTC access to the documents flawed. The conflict began in November 2023 with YMTC alleging patent infringement.

A legal battle between US chipmaker Micron and Yangtze Memory Technologies Co. (YMTC) has taken a new turn, as reported by media sources. The core of the dispute revolves around access to sensitive technical documents.

Micron is actively seeking to overturn a previous agreement and court rulings that would compel them to hand over 73 pages of 3D NAND technology documents to YMTC.

Micron is arguing that the documents, which they claim relate to national security concerns, should not be available to YMTC, a Chinese company that is on the US Department of Commerce’s entity list.

The conflict between YMTC and Micron began in November 2023, when YMTC initiated legal action against Micron in the United States, alleging infringement of eight of its US patents related to 3D NAND technology.

As the case progressed, evidence was requested. However, under a jointly agreed-upon protective order, access to highly sensitive materials was restricted to external lawyers and experts only. The order also limited the number of printed copies to a maximum of 1,500 pages, with no more than 30 consecutive pages per print run.

At the heart of the current disagreement, YMTC requested 73 printed pages from Micron’s “150 Series Traveler Presentation.” These pages contained information on Micron’s latest and upcoming 3D NAND devices.

In a statement, Micron highlighted that YMTC’s request for printed pages was “ten times” that of earlier generations of chips.

Despite the court’s eventual ruling, allowing YMTC access to the 73 pages, Micron maintains that the decision was flawed. They view the request as problematic, considering YMTC’s ties to the Chinese government, and is seeking to have the ruling overturned by a higher court.
