JD Auto was found guilty of unfair competition against Tuhu Car by the Shanghai Intellectual Property Court, stemming from JD Auto’s “Zhenhu Price” campaign. The court ruled the campaign constituted commercial disparagement and false advertising. JD Auto must cease the practices, pay Tuhu Car 5 million yuan in damages, and publish a statement across multiple platforms for ten days to mitigate reputational damage.
